Terms of Use

Numinad operates exclusively as a car rental price comparison and meta-search platform. We aggregate and display pricing data from third-party car rental booking platforms including Kayak, Skyscanner, Expedia, Agoda, and others, as well as direct feeds from car rental companies. We do not own, operate, or employ any rental vehicles, fleets, or physical rental counter locations.

Understanding this distinction is essential before using our platform:

• Numinad does not issue rental confirmations, vouchers, or booking references.
• Numinad does not collect payment for any car rental reservation.
• Numinad cannot modify, cancel, or access any reservation you make through a third-party provider.
• Numinad is not a travel agent and does not provide travel advice or make representations about the suitability of any specific rental company or vehicle for your purposes.

Numinad retrieves car rental pricing in real-time from partner APIs. We make significant technical efforts to display accurate, current rates. However, car rental pricing is highly dynamic and subject to change based on availability, seasonal demand, and provider pricing algorithms. You must be aware of the following limitations:

• Prices Are Not Guaranteed: Rates displayed on Numinad are live estimates retrieved at the moment of your search. The final price for your rental is only confirmed when you complete the booking on the provider's platform. Prices can change between when you see a result on Numinad and when you reach the provider's checkout page.
• Taxes and Fees: Displayed prices may or may not include all local taxes, airport surcharges, young driver fees, one-way rental fees, or other ancillary charges. We endeavor to display inclusive totals where data is available, but some fees are only disclosed at the provider's checkout page.
• Availability: Displaying a vehicle on our platform does not guarantee that vehicle or rate tier is available. Vehicle categories shown are representative; specific models within a category are subject to availability at the rental counter.
• Currency Conversion: Prices displayed in your local currency are converted from provider rates at approximate market exchange rates. The provider may charge you in a different currency depending on your pickup location.
• Stale Data: In rare cases, provider API responses may contain outdated pricing data. Numinad implements caching and fallback mechanisms but cannot guarantee every result reflects the absolute current rate.

By using Numinad, you acknowledge that clicking through to a third-party provider constitutes leaving the Numinad platform and entering into a relationship governed entirely by that provider's terms and conditions. Numinad bears no responsibility and accepts no liability for:

• The quality, safety, cleanliness, or condition of any rental vehicle provided by a third-party rental company.
• Any cancellation, modification, or denial of service by a provider, including in circumstances such as overbooking or fleet unavailability.
• Billing errors, unexpected charges, or disputes arising from a booking made on a third-party platform.
• Any inaccuracies in vehicle descriptions, photographs, or amenity listings provided by rental companies or booking platforms via their APIs.
• Loss, damage, injury, or other harm arising during or in connection with a car rental booked through a third-party provider.
• Any failure of a provider's website, app, or checkout process to complete a booking successfully.
• Third-party providers' compliance or non-compliance with consumer protection laws in your jurisdiction.

To protect the integrity and performance of our comparison service for all users, the following activities are strictly prohibited. By accessing Numinad you explicitly agree NOT to:

• Automated Scraping: Execute automated scraping, crawling, or bulk data extraction against any Numinad API endpoint, search interface, or results page. Our search infrastructure is built for human users, not programmatic extraction.
• API Abuse: Send automated, scripted, or bot-generated requests to our proxy API routes (`/api/*`) in volumes that exceed normal consumer usage patterns or that are intended to circumvent our rate limiting measures.
• Competitive Intelligence Harvesting: Use Numinad's aggregated pricing data for the commercial benefit of a competing car rental comparison service or travel technology company without explicit written authorization.
• Fraudulent Use: Attempt to manipulate search results, affiliate tracking parameters, or commission attribution in any way.
• Security Circumvention: Attempt to bypass, probe, or attack any security controls, authentication systems, or anti-abuse mechanisms on the Numinad platform.
• Harmful Content Submission: Submit search queries or contact form messages containing malicious code, cross-site scripting payloads, or injection attacks.
• Misrepresentation: Impersonate Numinad or represent yourself as affiliated with Numinad in any commercial communication.

The Numinad platform, including its search interface design, comparison layout, filtering systems, data visualization components, brand identity, and software code, is the proprietary intellectual property of Numinad and is protected by applicable copyright, trademark, and trade secret laws.

Third-party car rental company names, logos, trademarks, and brand assets displayed on Numinad are the property of their respective owners. Their appearance on our platform does not imply any affiliation with, endorsement by, or sponsorship from those companies beyond our standard affiliate and API partnerships.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any portion of the Numinad platform or its content without explicit written permission from Numinad.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NUMINAD AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS, LOSS OF DATA, OR PERSONAL INJURY, ARISING FROM OR RELATED TO YOUR USE OF THE NUMINAD PLATFORM OR YOUR RELIANCE ON ANY PRICING, AVAILABILITY, OR OTHER INFORMATION DISPLAYED THEREON.

In jurisdictions that do not allow the exclusion or limitation of incidental or consequential damages, Numinad's liability is limited to the maximum extent permitted by law.

Numinad's total aggregate liability for any claim arising from or related to the use of our platform shall not exceed one hundred US dollars (USD $100.00).

You acknowledge that the price comparison service is provided 'as is' and 'as available' without any warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

These Terms of Use are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. To the extent that state law applies, the laws of the state in which Numinad's principal place of business is located shall govern.

For users in the European Union: Nothing in these terms limits your rights under applicable EU consumer protection law, including the EU Digital Services Act (DSA) or applicable national consumer protection legislation.

We strongly encourage users to first contact us directly at numinad-support@gmail.com to attempt resolution of any dispute informally. Most concerns can be addressed quickly through direct communication.

If informal resolution fails, disputes arising from or related to these Terms of Use or your use of the Numinad platform shall be subject to binding arbitration under the rules of a recognized arbitration body, conducted in English, except where arbitration is prohibited by applicable law.

Class action waiver: To the extent permitted by law, you agree to resolve disputes with Numinad on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.

Nothing in this dispute resolution clause prevents you from filing a complaint with a governmental consumer protection agency or data protection authority.

Numinad reserves the right to modify these Terms of Use at any time. When we make material changes, we will update the 'Last updated' date at the top of this page. Your continued use of the Numinad platform after changes are posted constitutes your acceptance of the revised terms.

If you do not agree with any changes to these terms, you must stop using the Numinad platform.
